Terms of Service

1. The Service

MelonPosts allows users to create accounts and workspaces, upload or connect content sources, request ingestion of PDFs, websites, and YouTube content, and generate or refine draft outputs for social publishing workflows.

2. Eligibility And Accounts

• You must be legally capable of entering into a binding agreement and authorized to act for any organization using the service through your account.
• You are responsible for keeping account credentials secure and for all activity that occurs under your account or workspace.
• You must provide accurate account and billing information and keep it reasonably up to date.

3. Customer Content And Permissions

You retain responsibility for the material you upload, submit, connect, or ask MelonPosts to retrieve and process, including PDFs, website content, transcripts, prompts, instructions, and generated outputs stored in your workspace.

• You represent that you have all rights, permissions, and legal bases necessary to submit the content and to authorize MelonPosts to process it.
• You grant KP Ventures OÜ a limited, non-exclusive right to host, copy, store, transmit, retrieve, transform, analyze, and display Customer Content solely as needed to operate, secure, support, and improve the MelonPosts service in line with these Terms and the Privacy Policy.
• You must not submit content that infringes intellectual property rights, violates law, breaches confidentiality obligations, or contains personal data you are not permitted to provide for this use.

4. AI Outputs

MelonPosts uses automated systems and third-party AI providers to generate and refine outputs. AI-generated outputs may be inaccurate, incomplete, biased, non-unique, or unsuitable for your intended use.

• You are responsible for reviewing, editing, and approving outputs before publishing, relying on, or distributing them.
• MelonPosts does not guarantee that outputs will be original, infringement-free, factually correct, or fit for any legal, regulatory, employment, investment, or other high-stakes purpose.
• You remain responsible for your downstream use of any output generated through the service.

5. Acceptable Use

• Do not use the service to break the law, violate rights, send spam, misrepresent authorship, or distribute harmful, deceptive, or abusive content.
• Do not upload malware, attempt unauthorized access, interfere with the service, reverse engineer protected portions of the platform beyond what law allows, or bypass quotas, limits, or security controls.
• Do not use MelonPosts to process data where use of a general-purpose AI-assisted SaaS tool would be inappropriate without a separate written agreement.

6. Billing, Trials, And Subscription Terms

• Paid features require an active subscription unless explicitly offered on a trial or free-tier basis.
• Subscriptions renew automatically unless canceled before the next renewal date.
• Usage-based limits, credits, and plan restrictions apply as described in the product and may affect uploads, generations, or related features during a billing period.
• Fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, duties, and similar charges.
• Payments are processed by third-party providers such as Stripe. We do not control their separate terms or handling of payment data.

7. Cancellation, Suspension, And Termination

• You may stop using the service or cancel your subscription at any time through the available billing flow or by contacting support.
• We may suspend or terminate access if you materially breach these Terms, fail to pay amounts due, create risk to the platform or others, or use the service unlawfully.
• On termination, your right to use the service ends, but provisions that by their nature should survive will remain in effect, including payment, IP, disclaimer, limitation of liability, and dispute provisions.

8. Intellectual Property

• MelonPosts, including its software, workflows, branding, site design, and underlying service materials, is owned by KP Ventures OÜ or its licensors and is protected by applicable intellectual property laws.
• Except for the limited rights needed to use the service, these Terms do not transfer ownership of our software or service IP to you.
• As between the parties, and subject to third-party rights and model limitations, you may use outputs generated for your workspace for your internal business and publishing purposes.

9. Third-Party Services

MelonPosts relies on third-party providers for payments, infrastructure, AI processing, storage, communications, monitoring, and source integrations. Availability and performance may depend in part on those providers.

• We are not responsible for third-party products or platforms that are not controlled by us.
• Your use of third-party platforms, including YouTube, LinkedIn, Stripe, or linked sites, may also be subject to their own terms and policies.

10. Disclaimer Of Warranties

MelonPosts is provided on an as-is and as-available basis to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, error-free, or fully secure.

11. Limitation Of Liability

To the maximum extent permitted by law, KP Ventures OÜ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service or these Terms will not exceed the amounts paid by you to MelonPosts for the service during the 12 months before the event giving rise to the claim.

12. Indemnity

You will defend, indemnify, and hold harmless KP Ventures OÜ and its affiliates, officers, directors, employees, and contractors from claims, losses, liabilities, and expenses arising from your Customer Content, your use of the service, or your breach of these Terms.

13. Governing Law And Disputes

These Terms are governed by the laws of Estonia, excluding conflict-of-law rules. Courts in Estonia will have exclusive jurisdiction over disputes arising from or relating to these Terms or the service, unless mandatory law requires otherwise.

14. Changes To The Service Or Terms

We may modify the service from time to time. We may also update these Terms. If we make material changes, we will revise the effective date and provide additional notice where appropriate. Continued use of MelonPosts after the updated Terms take effect means you accept the revised Terms.
